1. Purpose and Scope
1.1. This Acceptable Use Policy (“AUP”) states the rules for using DIVAI’s products and services.
1.2. This AUP applies to all access to and use of:
- the DIVAI websites, including divai.ai and app.divai.ai;
- the DIVAI application and any application programming interfaces (“APIs”) DIVAI makes available; and
- all related services, features, and outputs provided by DIVAI (together, the “Service”).
1.3. This AUP applies to every customer and to every person who accesses the Service through a customer account (“you”). The Service is offered to business users and to individuals who are at least 18 years old.
1.4. This AUP is intended to be incorporated by reference into DIVAI’s Terms of Service. A violation of this AUP is a violation of those terms. Draft item pending confirmation before activation.
2. Prohibited Content and Conduct
You may not use the Service to create, process, store, transmit, or distribute content, or to engage in any activity, that:
2.1. Violates law. Is unlawful under applicable local, state, national, or international law, or that facilitates unlawful activity.
2.2. Involves fraud. Is fraudulent, deceptive in a manner intended to cause harm, or designed to obtain money, credentials, data, or access under false pretenses.
2.3. Involves malware. Creates, distributes, or deploys viruses, worms, ransomware, spyware, or other malicious or destructive code, or tools designed primarily to compromise systems.
2.4. Involves unauthorized intrusion. Accesses, probes, scans, or interferes with any system, network, account, or data without authorization, including penetration testing without DIVAI’s prior written authorization (see Section 4).
2.5. Infringes intellectual property. Infringes or misappropriates any third party’s copyright, trademark, patent, trade secret, or other proprietary rights.
2.6. Violates privacy. Collects, processes, or discloses personal data without a lawful basis, or violates any person’s privacy, publicity, or data-protection rights.
2.7. Involves child sexual abuse material (CSAM). Depicts, solicits, or facilitates the sexual exploitation or abuse of minors in any form. DIVAI has a zero-tolerance policy for CSAM. Suspected CSAM will be reported to the appropriate authorities, and involved accounts will be terminated. Draft item pending confirmation before activation.
2.8. Constitutes harassment or hate. Harasses, threatens, defames, or bullies any person, or promotes violence or discrimination against protected groups.
2.9. Spreads disinformation at scale. Generates or distributes materially false or misleading information at scale with intent to deceive, including impersonation and election-related disinformation.
2.10. Constitutes spam. Sends or facilitates unsolicited bulk messages, or harvests contact information for that purpose.
2.11. Involves deliberate deception. Uses the Service to deliberately deceive others in a manner that causes or risks material harm, including deceptive impersonation of real persons or organizations.
2.12. Is otherwise harmful. Is intended to cause, or creates a serious risk of, physical, financial, or psychological harm to any person, or damage to any system or property.
3. AI-Specific Rules
Because the Service uses artificial intelligence, you additionally may not:
3.1. Extract models, prompts, or system internals. Attempt to extract, replicate, or reverse-engineer the underlying AI models, system prompts, model weights, or proprietary configurations used in the Service. Draft item pending confirmation before activation.
3.2. Generate harmful content. Use the AI features to generate content prohibited by Section 2, or instructions intended to enable serious harm.
3.3. Automated abuse or scraping. Access the Service through automated means (bots, scrapers, crawlers) except through APIs DIVAI expressly provides and within their documented limits, or use the Service in a way that degrades it for others.
3.4. Bypass safety controls or rate limits. Circumvent, disable, or probe safety filters, content controls, authentication, usage quotas, or rate limits.
3.5. Misrepresent AI output as human where deceptive. Present AI-generated output as solely human-created where doing so is intended to deceive and causes or risks material harm.
4. Security Rules
4.1. You may not probe, scan, or test the vulnerability of DIVAI’s systems or networks, or breach any security or authentication measure, without DIVAI’s prior written authorization.
4.2. You may not use, share, or attempt to use another person’s credentials, API keys, or account. You may not permit unauthorized third parties to access your account. Credential abuse is prohibited.
4.3. You may not interfere with or disrupt the Service, servers, or networks connected to the Service.
5. Consequential-Action Rule
5.1. Definition. “Consequential external actions” are actions that affect systems or people outside your DIVAI workspace. Examples include sending messages to third parties, making purchases or payments, publishing content, and modifying or deleting data in external systems.
5.2. Explicit approval required. The Service is designed to require your explicit approval before it takes any consequential external action.
5.3. No unreviewed external automations. You must not configure, instruct, or work around the Service so that automations act externally without meaningful human review. You are responsible for reviewing and approving consequential actions taken on your behalf. Draft item pending confirmation before activation.
6. Customer Responsibility for Outputs
6.1. AI-generated outputs can contain errors, omissions, or fabricated content. This applies to software code, analyses, plans, text, and any other output.
6.2. Outputs are not professional advice — not legal, medical, financial, tax, accounting, or any other licensed professional advice. DIVAI does not provide such advice.
6.3. You must apply human review to important outputs before relying on them. You are responsible for all consequential decisions made using the outputs.
6.4. You are responsible for ensuring your use of the Service complies with the laws applicable to you and your business.
7. Enforcement
7.1. If DIVAI determines that you have violated this AUP, or that your use is abusive, risky, or fraudulent, or that an account is unpaid, DIVAI may, where lawful:
- issue a warning and request corrective action;
- restrict or suspend access to the Service, in whole or in part;
- terminate the account; and
- remove or disable violating content.
7.2. DIVAI may suspend access immediately, without prior notice, where use is unsafe or unlawful, or where reasonably necessary to protect the Service, other customers, or third parties.
7.3. DIVAI will provide notice of enforcement action where appropriate and where required by law. Draft item pending confirmation before activation.
7.4. Appeals. If you believe an enforcement action was made in error, contact security@divai.ai with the subject line “AUP Appeal” and a description of the circumstances. DIVAI will review reasonable appeals in good faith.
8. Reporting Abuse and IP Complaints
8.1. Formal reporting channel. To report abuse, suspected violations of this AUP, security vulnerabilities, or intellectual-property complaints (copyright or trademark), contact security@divai.ai. This is DIVAI’s public reporting channel for the matters listed above.
8.2. For intellectual-property complaints, include identification of the right claimed, the material at issue, and your contact information. Draft item pending confirmation before activation.
8.3. For security vulnerabilities, include sufficient detail to reproduce the issue. Good-faith security research reported to DIVAI will be handled without enforcement action where it complies with Section 4.

9. Sanctions and Export Compliance
9.1. The Service is offered globally where lawful. It is not offered where prohibited by applicable sanctions or export-control law.
9.2. You may not use the Service if you are located in, organized in, or ordinarily resident in a country or region subject to comprehensive sanctions, or if you are a person listed on any applicable sanctions or restricted-party list.
9.3. You may not use the Service for any end use prohibited by applicable export-control law, and you may not export, re-export, or transfer the Service or its outputs in violation of such law. Draft item pending confirmation before activation.
