1. How DIVAI Processes Your Requests with AI
1.1. DIVAI is an AI product. To answer your requests, DIVAI may send your requests — and the context needed to fulfill them — to approved third-party AI model providers for processing.
1.2. Requests are routed through OpenRouter, an intermediary routing service, to underlying AI model providers.
1.3. The underlying providers and models may change over time. DIVAI selects providers and models internally and may change routing for quality, cost, availability, or capability reasons. You are contracting with and using DIVAI. The specific provider or model handling a given request is not guaranteed to remain the same.
2. DIVAI Is the Product You See
2.1. DIVAI remains the visible product and your point of contact. The providers, models, and routing stay behind DIVAI.
2.2. Where disclosure of a provider or model is legally required — or is required by a provider’s terms — DIVAI will make that disclosure. Required disclosures remain available to you. Draft item pending confirmation before activation.
3. How Your Data Is Treated by Providers
3.1. Data sent to third-party AI providers is governed by DIVAI’s approved provider and data-handling policies, and by each provider’s own terms.
3.2. DIVAI does not claim zero data retention. DIVAI does not claim that any provider applies zero retention, and DIVAI does not make that claim for itself. Any statement about provider retention or training behavior must be supported by verified provider terms before it is published. Draft item pending confirmation before activation.
3.3. Sensitive data. Sensitive data is routed only through approved providers, under least-data rules: DIVAI sends only the data needed to fulfill the request.
4. Project Brain Is DIVAI’s Memory, Not Provider Memory
4.1. Project Brain is DIVAI’s own project memory feature. It is how DIVAI remembers your project’s context so that work continues coherently.
4.2. Project Brain is DIVAI’s own system. It is not the memory of any third-party AI provider. Changing AI providers does not move your project memory to any provider.
4.3. Whether a provider separately retains request data under its own terms is a different question. It is addressed in Section 3. It does not affect where your project memory lives.
5. AI Results Can Be Wrong — Review Before You Rely
5.1. AI-generated results can contain errors, omissions, or fabricated content. This applies to software code, analyses, plans, text, and any other output.
5.2. Outputs are not professional advice — not legal, medical, financial, tax, accounting, or any other licensed professional advice. DIVAI does not provide such advice.
5.3. You should review important outputs before using them for anything consequential. Human review is recommended before any consequential use. You are responsible for decisions made using the outputs.
6. Consequential External Actions Require Your Approval
6.1. DIVAI can automate actions that affect systems or people outside your DIVAI workspace. Examples include sending messages to third parties, making purchases or payments, publishing content, and modifying or deleting data in external systems.
6.2. DIVAI is designed to require your explicit approval before taking any such consequential external action. Do not configure or work around the Service so that such actions happen without your review.

7.1. EU AI Act. Do DIVAI’s activities trigger transparency or other obligations as a provider or deployer of an AI system serving EU users? What disclosure language would be required, and where?
7.2. US state laws. Do any state AI-disclosure laws require disclosure that customers are interacting with AI, disclosure of providers, or impact assessments? Which states, and on what timeline?
7.3. Sector-specific rules. If customers use DIVAI in regulated contexts (employment, credit, housing, health), do additional disclosure obligations attach to DIVAI or only to the customer? How should the terms allocate this?
